A defendant shall be punished by imprisonment for not less than one year and six months.
Seized evidence No. 1 shall be confiscated.
Punishment of the crime
1. Around April 30, 2018, the Defendant violated the Immigration Control Act and the obstruction of the performance of official duties by fraudulent means entered the Republic of Korea as a mentor national foreigner, and as a non-Visa tourist guide (B-2-2).
The defendant, upon receipt of an application for refugee status, can legally stay in the Republic of Korea after the expiration of the period of stay due to changes to the status of stay or other (G-1-5). Even if the application for refugee status was rejected through a review, the defendant knew that the period of stay may be extended until the completion of a lawsuit by filing an objection, an administrative appeal, or an administrative litigation, even if the application for refugee status was rejected through a review, the defendant was willing to submit an application for refugee status stating that the defendant's wife died as a bomb terrorism to the Republic of Korea, regardless of the fact that the defendant's wife died as a bomb terrorism.
On May 5, 2018, the Defendant: (a) at the Jeju Immigration Office, the Jeju Immigration Office; and (b) notwithstanding the fact that his wife was dead due to a vehicle bomb terrorism, the Defendant stated in the column of personal statement of the refugee application that “I died due to a bomb by the U. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S. S.S. S.
As a result, the Defendant applied for permission by unlawful means, such as submitting an application stating false facts, and at the same time interfered with legitimate execution of duties concerning permission to change the status of stay of public officials in charge of Jeju Immigration and Foreign Affairs.
2. Uttering a falsified investigation document;
A. On October 31, 2018, the Defendant is required to submit a certificate of death that the Defendant’s wife died from a public official in charge of entry into and departure from Jeju under paragraph (1) at the place specified in paragraph (1). It was forged.
