피고인은 2015. 12. 11. 18:35 경 김해시 B에 있는 ‘C’ 식당에서 술에 취한 채 소란을 피우다가, 112 신고를 받고 출동한 김해 중부 경찰서 OO 지구대 소속 경위 D, 순경 E로부터 제지 당하고, 그 무렵 위 경찰관들이 피고인을 순찰차에 태워 관할 경계 지인 김해시 F 앞 노상까지 태워 다주 었음에도 불구하고, 특별한 이유 없이 위 경찰관들에게 “ 씨 발 놈 아 대갈빡을 깬다, 씨 발 놈들 아 모가지를 따 버린다 ”라고 욕설을 하고, 몸으로 위 순경 E의 몸통을 밀치고 손으로 위 순경 E의 견장을 떼고 조끼를 잡아당기고, 위 경위 D이 이를 제지하자 손으로 위 경위 D의 가슴 부위를 수회 밀쳤다.
