마약류관리에관한법률위반(향정)
A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Punishment of the crime
Even if the Defendant is not a narcotics handler,
1. On October 2, 2014, around 24:00, the Defendant received approximately 2g of the Mesofts (one philopopon; hereinafter “philopon”), a local mental medicine, from D, by receiving approximately 2g of the Melopon and philopon from D.
2. On January 9, 2015, around 22:00, the Defendant traded phiphones by receiving approximately 40,000 won from the street of the F Hospital located in Yongsan-gu Seoul Metropolitan Government, D and approximately 0.3g of philophones.
3. On January 10, 2015, the Defendant traded philophones by receiving approximately 150,000 won from D and approximately 0.3g of philophones at the front of the F Hospital, around 22:00.
4. On January 11, 2015, the Defendant received philophones by receiving 0.4 grams from D without compensation at the H’s residence located in Mangsan-dong G 402 Dong-dong-gu G 703, Manyang-gu, Mangsan-si, G 402 Dong-gu, and received philophones.
5. On January 13, 2015, the Defendant received philophones by receiving approximately 0.5 gopon from D without compensation, from a telecom room where the trade name in Songpa-gu Seoul Metropolitan Government I is unknown, around 22:00.
6. On January 14, 2015, the Defendant received philophones by receiving approximately 0.4g 0.4g philophones from D, at the street in the vicinity of the F Hospital, around 24:00.
7. On January 22, 2015, at around 20:00, the Defendant received phiphones by receiving approximately 0.4g gramphones from D without compensation at the room of “J” No. 1 in the vicinity of the F Hospital.
8. The Defendant 1 administered philophones by inserting approximately 0.05g of the philophones received as above at the same time and at the same place as above 7.7.
9. At around 17:00 on January 31, 2015, the Defendant received philophones by receiving approximately 0.7 gramopon from D without compensation, within D’s car parked in the vicinity of L Hospital located in Gangnam-gu Seoul, Gangnam-gu, Seoul.
10. The Defendant is Gangnam-gu Seoul around 03:00 on March 23, 2015.
