1. Details of disposition;
A. On August 19, 2014, the Plaintiff opened and operates the office of “D Licensed Real Estate Agent” in subparagraph C of the building B in Namyang-si, Namyang-si.
B. The Plaintiff, among E (a lessor who completed the business registration; hereinafter referred to as “leased”) and F (a lessee; hereinafter referred to as “Lessee”), arranged a monthly rent contract (a security deposit of KRW 3 million, KRW 280,000, KRW 280,000 per month) for G apartment H. In the process, the Plaintiff drafted the apartment monthly rent contract (hereinafter “instant monthly rent contract”) on July 5, 2018.
The identity of the lessor, lessee, and broker of the monthly rent contract of this case was printed, and the seal was affixed to the name of the lessor, and the signature was affixed to the name of the lessee. However, no signature or seal was affixed to the broker.
C. On the same day as the monthly rent contract of this case, an explanatory note confirming the object of brokerage (hereinafter “instant explanatory note”) was prepared, and the stamp was stamped on the side of the lessor’s name while personal information of the lessor, lessee, and broker was printed, and the agent was signed on the side of the lessee’s name. However, the agent’s name was written, and the part of the lessor and lessee’s name was “signing or sealing.” However, the agent’s name was “signing or sealing.”
As the former Enforcement Rule of the Special Act on Private Rental Housing (amended by Ordinance of the Ministry of Land, Infrastructure and Transport No. 601 on February 27, 2019) deleted by the amendment on February 27, 2019, attached Form No. 25 (Standard Lease Contract) based on Article 20(1)2 of the Enforcement Rule of the Special Act on Private Rental Housing (amended by Ordinance of the Ministry of Land, Infrastructure and Transport as of February 27, 2019), the uniform form was converted into Attached Form No. 24 (Standard Lease Contract). The uniform form was partially amended on October 29, 2019, and only the practicing licensed real estate agent (Signature and seal) was changed into “the standard form” (hereinafter referred to as “the standard form contract”) on July 23
All personal information of both a lessor, lessee, and broker is printed, respectively, in the name of the lessor and the lessee.
