1. Defendant A is an operator of a game room with no trade name on the first floor of Seo-gu Daejeon, Seo-gu, Daejeon, and theO is a person employed by Defendant A as a person in charge of money exchange business, preparation of books, etc. in the above game room.

No one shall engage in speculative activities as a business by using speculative gaming machines, and shall provide non-grade game products for the distribution or use, or exchange or arrange exchange of tangible or intangible results obtained through the use of game products.

Nevertheless, on May 13, 2013, from May 15, 2013 to May 15, 2013, the Defendant had an unspecified number of customers who visited the place by installing 50 game machine of “Yato”, which is a speculative machine not classified among the customers from around 13, 2013, put 10,000 won into the game machine, and then had them play the game by allowing them to obtain specific points according to the number associations on the face value of the screen, and then exchanged in cash after deducting 10% of the money exchange commission from the points they acquired through the game.
