A defendant shall be punished by imprisonment for not more than ten months.
The defendant shall be ordered to complete a sexual assault treatment program for 40 hours.
Punishment of the crime
1. No person who violates the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (obscenity using communications media) and the Act on Promotion, etc. of Utilization of Information and Communications Network Utilization and Communications Network Utilization and Information Protection, etc. (obscenity) shall send words, sounds, letters, pictures, images, or things that may cause a sense of sexual shame or aversion to another person by telephone, mail, computer, or other communications media, with intent to arouse or satisfy his/her own or the other person's sexual desire, and no person shall distribute, sell, lease, or openly exhibit any obscene codes, words, sound, image, or images through information and
가. 피고인은 2019. 7. 13. 10:04경 피해자 B가 재직하는 학교에서 2018년 담임을 맡았던 학급의 네이버 밴드 ‘C중학교 1학년4반’ 대화방에 “나많이 능욕해줘 씹보지 열심히 벌릴께ㅎㅎ”라고 적혀있는 피해자의 얼굴과 나체사진이 합성된 사진을 게시하였다.
B. At around 18:40 on July 13, 2019, the Defendant posted the same photographs as described in paragraph (a) on the bandon bandon “1st class 1st class group of 2019 C” page of the class at which the victim is currently in office.
Accordingly, the Defendant reached the victim with a view to meeting his own sexual desire through a communication medium, and simultaneously displayed obscene images openly with the intent to cause a sense of sexual humiliation through the communication medium.
2. No person who violates the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Defamation) shall reveal any false fact openly through an information and communications network to defame another person;
