Defendant shall be punished by a fine of KRW 7,000,000.
When the defendant does not pay the above fine, 100,000 won.
Punishment of the crime
No lessee of a public rental apartment may transfer or sublease the right of lease to any third person, except where any reason, such as work, occupation, and treatment of disease, occurs after all the members of the household of the rental house move into the rental house, and no one shall arrange for such transfer or sublet.
On November 15, 2011, the Defendant concluded a lease agreement with the Korea Land and Housing Corporation (hereinafter “LH Corporation”) (hereinafter “LH Corporation”) and the Suwon-si, Suwon-si, Gyeonggi-do, Suwon-si, 362 complex C62, 6206 Dong 1203, and acquired the right to lease on the apartment.
On June 16, 2015, the Defendant operated “D” in an apartment commercial building in the above C60 apartment complex.
According to E’s instructions, the Defendant did not have been employed by the head of the Center for Housing Welfare in the LH Corporation located in Young-gu, Suwon-si, Suwon-si, Suwon-si, and submitted documents for the transfer of the right of lease by attaching a false certificate of employment, etc. despite the fact that the Defendant was employed by the head of the Center for Housing Welfare in the 467-27, Changcheon-si, Changcheon-si, Changcheon-si, and filed a false move-in report.
On October 23, 2015, the Defendant entered into a contract of succession to the right and duty that the housing welfare center in the above LH Corporation (hereinafter referred to as the “Housing Welfare Center”) succeeds to all the rights and obligations regarding the right and obligations of the said apartment, and transferred the right and obligations to G.
Accordingly, the defendant transferred the right of lease by pretending to the fact that there is no legitimate reason for the transfer of the right of lease
