However, from the date of the final judgment of this case, the defendants are above two years from the date of the final judgment.

The Defendants, along with E, purchased real estate similar to the rent deposit and the purchase price of the real estate, followed the appearance of the real estate by preparing a false lease contract with a significantly lower amount than the actual lease deposit, as if the real estate has a value as collateral, and intended to acquire money by providing the real estate as collateral. Defendant B had the aforementioned real estate purchased and borrowed money, Defendant A had the role of forging the real estate lease contract necessary for committing the crime, and E had the role of directly deceiving the victim.

1. From July 2015, Defendant A: (a) stated in the coffee shop operated by Defendant B in Gangnam-gu Seoul, Seoul, that the deposit for the lease of the building was actually 160 million won; (b) stated in the column for the location of the site for “real estate lease agreement” the “401st floor of Dobong-gu Seoul, Seoul; (c) 401st floor of the fourth floor; (d) 30 million won in the deposit column; (d) 30 million won in the rent column; (e) 202nd building in Yongsan-gu, Seoul, 2903; (d) 1 in the lessor’s name column; and (e) stated in the lessee’s address column as “J” in the name column for the second floor of the building of Dobong-gu Seoul, Seoul; and (e) made advance preparation and seal attached to I and J.

As a result, the Defendants forged one copy of the real estate lease agreement under the name of I and J, a private document related to rights and obligations, in collusion with E for the purpose of exercising them.

2. On July 23, 2015, the event of the above investigation document and the fraud E purchased a loan equivalent to KRW 160 million from the part payment to the victim N, who arranged by Defendant B, as described in paragraph 1, at the L coffee shop located on the 15th floor of Jongno-gu Seoul Metropolitan Government building, with the view to showing the forged real estate lease agreement, etc. of KRW 401, G building, as described in paragraph 1, and the part payment is insufficient.
