However, the above sentence shall be executed for three years from the date this judgment becomes final and conclusive.

1. Defendant A

A. With respect to the report of birth of K, (1) with respect to the fabrication of a private document, the use of a false research document, the use of a public electronic record, etc., the Defendant and L, and E, with respect to a false report of birth between the husband and wife of Vietnam who illegally stays in the Republic of Korea (hereinafter “Vietnam”) as if they were the husband and wife of Vietnam who were born born a child (hereinafter “Vinam”) and were issued a passport of the Republic of Korea of the relevant child, and then recruited to Vietnam to obtain the passport of the relevant child.

Accordingly, L around May 2012, around 11:02, at its own house located in Gyeyang-gu Incheon, and around February 16, 2012, L proved by doctor Qu (license number R) that he was born between E and P at the O Hospital located in Seocheon-gu, Seocheon-gu, Busan, and at around February 16, 2012, L signed and sealed the seals in the name of O Hospital and Q prepared in advance.

After that, around June 4, 2012, E submitted a false report of birth in Yeonsu-gu Incheon, Yeonsu-gu, Incheon, such as a false report of birth in the name of a person who was born, K, and father E as if he was his own child, to the public official in charge as if he were a document in charge. A public official who is not aware of such circumstance submitted a forged birth certificate as mentioned above and then entered the reported details into the family relation registration system, which is the same electronic record as the original copy of the notarial deed, and then the above system was operated.

In this way, the Defendant, in collusion with L and E, forged a birth certificate in Q’s name, which is a private document related to the certification of facts without authority, and exercised the certificate by making the false facts recorded in the public electronic record.

(2) The unlawful issuance of a passport and the non-entry E in a passport, according to the above public offering, in the Yeonsu-gu Office civil service offices located in Yeonsu-gu Incheon, Yeonsu-gu, Incheon, on June 2012, the application for issuance of a false report of birth under the above false name.
