1. The Defendant’s KRW 26,00,000 as well as 5% per annum from July 11, 2006 to October 25, 2015 to the Plaintiff.
Reasons
1. Indication of claims: To be as shown in the reasons for the application;
(However, ‘creditor' is considered as ‘Plaintiff', and ‘debtor' as ‘suspect'. 2. applicable provisions of law: Article 208(3)1 of the Civil Procedure Act (a non-litigation judgment).
3. Partial dismissed portion: The portion of a claim for delay damages exceeding the rate of 15% per annum pursuant to the provisions on statutory interest rate under the main sentence of Article 3 (1) of the Act on Special Cases Concerning Expedition, etc. of Legal Proceedings (Presidential Decree No. 26553, Oct. 1, 2015) shall be dismissed.
