Punishment of the crime
[Criminal Power] On March 5, 2015, the Defendant was issued a summary order of KRW 1.5 million by the Seoul Southern District Court for the crime of violation of the Road Traffic Act.
【Criminal Facts】
1. Around 23:40 on March 6, 2020, the Defendant driven the “C” road in front of the “C”, which is under the influence of 0.150% of blood alcohol concentration, and driven the automobile from the border of the Tricheon River to the Geumcheon B, while driving the automobile under the influence of 0.150% of alcohol concentration.
Since there is a intersection of a distance where signal lights are installed and a road where a central line is installed, the driver of the motor vehicle has a duty of care to safely drive the motor vehicle in accordance with the signals and prevent accidents by driving the motor vehicle in a safe manner by driving the motor vehicle along the right side of the central line.
Nevertheless, under the influence of alcohol, the Defendant, while driving in the reverse direction from the first lane of opposite parts while neglecting the red stop signal on the intersection, was driven by the victim E (the age of 27) who was standing in the traffic signal at the second lane of opposite parts in the front of the FK5 car as the front of the Defendant’s car.
As a result, the Defendant: (a) driven the said car in a state where it is difficult to drive the car normally due to influence of drinking, such as walking, walking, and walking the horses; and (b) suffered injury to the said victim, such as salt, tension, etc., of the trend requiring treatment for about three weeks.
