Purport of claim and appeal

A. The plaintiff is the council of occupants' representatives of Yongsan-gu Seoul Metropolitan Government apartment complex A (hereinafter "the apartment of this case"). A management body A (hereinafter "the management body of this case") is an organization composed of non-residential parts such as officetels and commercial buildings among the apartment of this case. C, the representative of the management body of this case, entrusted the management affairs to the plaintiff in whole.

B. 1) Subparagraph E (E) of the instant apartment building (a business facility building with the underground 9 floors and 27 floors above ground) (hereinafter “E”).

2) The apartment building G (hereinafter referred to as “Gho Lake”) of this case and Fdong (the apartment on the ground of nine floors, and on the ground of thirty-five floors) G

As to H on September 11, 2013, the registration of initial ownership was completed on September 11, 2013 with 26/50 shares, I, and J shares, 11/50 shares, K, and L respective 1/50 shares, and 26/50 shares of H (Death on February 29, 2016; hereinafter “the deceased”) in E and G were subsequently registered on June 15, 2016 with shares of 78/350 in the name of the Defendant, the wife’s wife, Ma, and N, with shares of 52/350 shares, and each registration of transfer was completed on April 27, 2017 with respect to shares of the deceased for inheritance by consultation division.

C. 1) On November 28, 2013, the Deceased paid KRW 599,00 in advance of the payment of the management expenses for Hoho Lake and KRW 730,000 in advance of the management expenses for Ghoho Lake, and each occupancy certificate states that “I confirm that the occupants should bear the management expenses on the basis of the upper date.” The Deceased received the notice of payment of the management expenses and the notice of payment of the contributions, and each household key, prepared each occupant card, consented to the use of the occupant card information, and received each management rules and the management contract. 2) On July 1, 2014, the Deceased prepared an occupant record card under subparagraph E while the Deceased’s father’s wife’s father resides, and registered as a vehicle for use on July 22, 2014.

On July 22, 2014, the Deceased prepared a certificate that he/she is the actual user of G, and attached the certificate of registration of the said BMW vehicle and also attached the said vehicle to G.
