The judgment below

In light of the records, the court below is just in maintaining the judgment of the court of first instance that acquitted the charged facts of this case on the ground that there is no proof of crime. Contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the legal principles on the crime of violating the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Embezzlement) or by misapprehending the legal principles on the crime of violating the Act on the Aggravated Punishment

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
