The prosecution of this case is dismissed.
1. Around 10:00 on January 6, 2013, the Defendant assaulted the victim’s left side buckbucks one time by walking the victim’s left side buckbucks in the restaurant boiler room: ‘‘(D) on the ground that the victim E (52 years of age) interferes with the Defendant’s operation of boiler installation while taking a bath.
2. The facts charged in the instant case are crimes falling under Article 260(1) of the Criminal Act, which can be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. The victim withdrawn his/her wish to punish the defendant on July 2, 2013, which is the fifth trial date of the instant case, and thus, the public prosecution in the instant case is dismissed in accordance with Article 327(6) of the Criminal Procedure Act.
