1. The Defendant: 104,922,042 won to Plaintiff A; 106,922,042 won to Plaintiff B; 3,000,000 won to Plaintiff C; and each of the said money.

Reasons

1. Basic facts

A. A. Around 23:50 on December 21, 2013, the network D (hereinafter referred to as “the network”) was on the part of the Plaintiff B, driving the EM5 vehicle on the auxiliary seat, and driving the Plaintiff B, leading to one-lane of the two-lanes of the 355.9 km at the middle side of Gwangju City, Jung-gu, Seoul, China, along the two-lanes of the two-lanes, the dives (hereinafter referred to as “the instant dives”). As a result, the said dives part of the dives attached on the left side of the vehicle, which was set up in the direction of driving the said vehicle, led to the death of the Deceased due to brain damage (hereinafter referred to as “the instant accident”).

B. The instant accident site is a point where approximately 1.5 km elapsed from the place where the middle and the middle-sized Highway are separated, and approximately 50 meters elapsed after the passage through the mountain sculp (240m in length) and the two-way side of the instant road from the mountain sculp, there is a light separation cost for the left side of the instant road from around 9m to the horizontal green belt and about 15m slope, and the two-way side highways are located in the right side of the instant road at approximately 21.5m in width to the left side of the instant road, and about 8.3m away from the height of 8.3m in height to the upper side of the said slope sculp, which are the opposite side of the said slope.

C. At the time the instant road was opened on November 29, 2001, three street lamps and three street lamps were installed on the left side of the instant road at a certain interval from the point of the instant accident, and three street lamps, including the instant street and the instant road, have been installed on the left side of the instant road. The said three street and the instant road have been under control at a level of about 12 meters in length (hereinafter “the instant street”). D.

At the time of the instant accident, the foregoing street was removed and moved to a nearby roadside rest area, but there were still street lamps protection caps and the instant drails, etc., and the said drails was removed after the instant accident.
