A. The defendant applied for a payment order under Paragraph (1) against the plaintiff and received a payment order on March 29, 2006, and the above payment order was finalized on April 20, 2006.

B. The Defendant’s claim for the purchase price based on the Switzerland sales contract on June 10, 200 against the Plaintiff, which was the basis of the Defendant’s claim for the above payment order, was extinguished by the statute of limitations for a short period of three years, as “the price for the goods sold by the producer and merchant” under Article 163 subparag. 6 of the Civil Act.
