The prosecution of this case is dismissed.
Reasons
1. On September 20, 2017, the Defendant: (a) around 22:00, the Yeonsu-gu Incheon Metropolitan City building C. 401 and drinking alcohol; (b) the Defendant, under the influence of alcohol, got off the victim’s knee and panty to the kneee and knee, knee; and (c) had sexual intercourse with the victim by inserting the Defendant’s sexual organ into the part of the victim’s knee.
2. According to the records, the Defendant’s death on January 26, 2018, which was after the prosecution of this case, is recognized. Thus, the instant public prosecution is dismissed pursuant to Article 328(1)2 of the Criminal Procedure Act, and it is so decided as per Disposition.
