A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for a period of three years from the date this judgment becomes final and conclusive.
Punishment of the crime
1. Notwithstanding the fact that the Defendant is not a narcotics handler, the Defendant dealt with the following Metropha, which is a local mental medicine (hereinafter “philophone”), as follows.
A. On August 2020, the Defendant organized a team to sell philophones with around B, etc. on August 23, 2020. On August 23, 2020, the Defendant: (a) met with B, around 14:00, a person who purchased philophones, and (b) paid KRW 100,000 in cash from D, and dried up a philophones.
Accordingly, the Defendant conspired with B to sell philophones.
B. On June 21, 2019, the Defendant offered to purchase and administer phiphones with D. After gathering money from D to purchase phiphones, D conspired with D to purchase phiphones, and to use Cambodia’s name (E; hereinafter “E”) and HH’s account used by F to transfer 300,000 won of phiphones to the said E and F’s account near the K Station located in the Dong-gu Daejeon District, Daejeon District. At the same time, the Defendant purchased phiphones from them with a large amount of phiphones, and then purchased the said phiphones in collusion with D 1 through D 1 through 8 in collusion with D 30,000 by placing the said phiphones in aluminium with a high quantity of aluminium, and then making it stated in the attached list 1 through 1 through 8 in collusion with D 1 through 300,000.
Accordingly, the defendant purchased and administered philophones in collusion with D, B, etc.
2. A defendant in violation of the Immigration Control Act enters the Republic of Korea as a non-professional employment (E-9) around January 13, 2014, and despite the expiration of the period of sojourn on May 20, 2018, the defendant in violation of the Immigration Control Act shall enter the Republic of Korea from the following day until November 24, 2020.
