On October 25, 2018, the Plaintiff paid 60,000,000 won to Defendant B for reimbursement on August 25, 2019, and Defendant C guaranteed Defendant B’s above obligations.

On the same day, the Plaintiff set KRW 60,000,000 to Defendant C on August 25, 2019 for the repayment period, and Defendant B guaranteed the above obligation of Defendant C.

[Grounds for recognition] According to Gap evidence Nos. 1 (including branch numbers) and the purport of the entire pleadings, the defendants are jointly and severally liable to pay to the plaintiff losses for delay calculated at the rate of 120,000 per annum under the Civil Act from Aug. 26, 2019 to Oct. 13, 2020, which is clear that the original copy of the payment order or the copy of the complaint of this case is served on the date when the original copy of the payment order of this case or the copy of the complaint of this case is served on the plaintiff from Aug. 26, 2019 to Oct. 13, 2020, and from the following day to the date of full payment.

Therefore, the plaintiff's claim is justified and it is so decided as per Disposition.
