건물철거 및 토지인도 등

1. The defendant shall be the plaintiff.

(a) 6,502,584 won and the rate of 20% per annum from November 14, 2013 to the date of complete payment.

Reasons

1. Facts of recognition;

A. On August 13, 199, E completed the registration of transfer on the instant land, F large 264.5 square meters (hereinafter “F land”), G large 1209 square meters (hereinafter “G land”), based on an inheritance by consultation or division, and the registration of transfer on the H large 17 square meters (hereinafter “H land”) based on sale on June 3, 2010.

B. On June 21, 2011, the Plaintiff and I completed the registration of ownership transfer based on public sale with respect to Plaintiff 2/3 shares, I/3 shares in the instant land, and the Plaintiff completed the registration of ownership transfer based on sale with respect to Plaintiff 1/3 shares in their ownership on the same day.

C. Meanwhile, on June 23, 2005, E completed the registration of ownership transfer for a building listed in the separate sheet (hereinafter “instant building”) on the same day, E completed the registration of ownership transfer for reasons of sale to J on the same day, and J completed the registration of ownership transfer for the Defendant on March 11, 2009.

이 사건 토지는 C, F, G, H 각 토지와 지적 경계를 이루며 연접하여 있고, 이 사건 건물은 이 사건 토지를 포함한 위 각 토지 4필지에 걸쳐 존재하고 있는데, 이 사건 토지 중 별지 참고도 표시 11, 12, 8, 9, 4, 10, 11의 각 점을 차례로 연결한 선내 ㈎, ㈏부분 150.8㎡에는 이 사건 건물의 1층과 2층 일부가, 같은 참고도 표시 13, 14, 15, 7, 8, 12, 13의 각 점을 차례로 연결한 선내 ㈐부분 19.9㎡에는 이 사건 건물의 계단 및 복도가 각 위치하게 되었다.
