1. The Defendant: 5% per annum from December 29, 2012 to August 10, 2015, and August 11, 2015, to the Plaintiff. < Amended by Presidential Decree No. 26542, Aug. 11, 2015>
According to the purport of the evidence Nos. 1 and 5 and the purport of the entire pleadings as to the above monetary loan contract, the Corporation Dolin Construction Co., Ltd. (hereinafter only referred to as "Dolin Construction") borrowed KRW 500,000,000 from the Plaintiff on March 22, 2012, and entered into a monetary loan contract for KRW 250,000 on May 15, 2012 for KRW 250,000 on the remainder 250,000,000 on the remainder as of December 7, 2012, and the notary public entered into an executory deed as of December 429, 2012 on the above monetary loan contract (hereinafter referred to as "loan money under the above monetary loan contract"), and the Defendant cannot recognize the fact that a joint and several surety against the Plaintiff on December 28, 201.
According to the facts found above, the Defendant is obligated to pay to the Plaintiff the amount of KRW 100,00,000, which the Plaintiff seeks from December 29, 2012 to August 10, 2015, calculated by the rate of 5% per annum prescribed by the Civil Act, from August 11, 2015 to September 30, 2015, and the amount of delay damages calculated by the rate of 20% per annum from August 11, 2015 to October 1, 2015 to the date of full payment.
Therefore, the plaintiff's claim of this case is accepted within the scope of the above recognition, and the remaining claim is dismissed as it is without merit. It is so decided as per Disposition.
