1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
1. Details of the disposition;
A. The Plaintiff is a student attending a D High School with the principal from March 2015.
B. The Plaintiff’s first-year attending teacher of high school indicated the Plaintiff’s behavior characteristics and the Plaintiff’s comprehensive opinion column (year 1) in the Plaintiff’s school life records as follows.
The phrase “the part of this case’s order” refers to the part of the case’s order where: (a) there is a string, high concentration and will in the area of his own good faith; (b) there is a great interest in external appearance; (c) it is pointed out to the teachers or teachers in charge of life counselling who are frequently in violation of the school regulations, but the attitude is unbrupted; and (d) it is still inconsistent with the school regulations, due to the lack of the intention to dismiss (hereinafter “the part of this case’s order”).
C. On July 7, 2016, the Plaintiff’s mother C requested the Defendant to correct the part in this case, but the Defendant respondeded to the Plaintiff’s refusal on July 8, 2016.
On July 11, 2016, the Defendant held a school performance management committee and decided not to correct the part of the instant order pursuant to Article 19(1) of the former Guidelines for the Preparation and Management of School Life Records (amended by Ministry of Education Directive No. 169, Apr. 5, 2016; hereinafter “instant Directive”).
E. C filed a civil petition on the instant part at the E Busan Busan Metropolitan Office of Education’s National Education Newspapers.
Accordingly, the Busan Metropolitan Office of Education's Office of Education prepared to C, on July 26, 2016, the part in this case in which the teacher in the first year was recorded, by referring to evaluation data, and if the plaintiff's side submits objective data that can reflect on the part in this case to the defendant, it may examine whether the defendant's school performance management committee correct school life records.
