1. Basic facts
A. B completed the registration of ownership transfer on July 16, 1971 with respect to the real estate listed in the separate sheet (a) on July 16, 1971 as to the real estate in the separate sheet (a 34,512 square meters in light of the name of a mine, C, and hereinafter “instant real estate C”), and thereafter D, E, and F completed the registration of ownership transfer on September 10, 204 with respect to each of the above real estate on March 18, 2004 due to inheritance by consultation division. < Amended by Presidential Decree No. 18508, Sep. 10, 2004>
The defendant is currently the owner of the above real estate after completing the registration of ownership transfer on May 16, 2005 due to payment in kind of national tax on May 4, 2005.
B. G purchased from the previous owner I on May 15, 1964 and completed the registration of ownership transfer on May 25, 1964, of H 92 square meters of H 992 square meters (hereinafter “instant H real estate”).
Then, as G dies on December 12, 1982, G, ASEAN, completed the registration of ownership transfer on March 10, 1997 due to the inheritance of property on December 12, 1982, K, which is a son of J, completed the registration of ownership transfer on January 10, 207 due to the inheritance by consultation division on August 5, 2002. Finally, the Plaintiff, as K’s wife, completed the registration of ownership transfer on March 13, 2007 due to the donation on March 12, 2007.
C. G newly constructed a cement tank and a 62.15 square meters of forest land on the ground (hereinafter “instant housing”) in the part of the instant land, which connected each point of the annexed drawing Nos. 1, 2, 3, 4, 5, 6, 7, 8, and 9 in sequence, among the instant C real estate, on the ground of the 992 square meters of forest land on the instant land (hereinafter “instant land”), and approved the use of the said building on January 1, 1965, and registered L (L was the wife of G, but a consultation was combined around September 2, 1957) as the owner.
L was killed on April 30, 1987, and until then, the real estate registration of the instant housing has not been completed, but the J, which is the son of L, for the first time on August 5, 1996, on the said housing.
