A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
On January 29, 2008, the Defendant was sentenced to a fine of 500,000 won for a violation of the Road Traffic Act at the Seoul Southern District Court on January 29, 2008, and was sentenced to a fine of 2 million won by the Seoul Southern District Court on April 14, 2008.
1. On June 21, 2014, at around 04:25, the Defendant: (a) driven a car under the influence of alcohol with a blood alcohol concentration of about 0.217% from the section of about 3km to the three-lane (Korean Han River LP-N22) road in the same city of Han River in the same day from the front road of an apartment apartment that is located in the long-term city of Gyeonggi-si, Kimpo-si; (b) around 04:30 on the same day.
2. The Defendant, while under the influence of alcohol concentration of 0.217% in a temporary border like the preceding paragraph, was driving a car by driving the car above B, and driving a car at the LP-N22 points in the Han-ro Kimpo-ro in the Seoul direction from the Kimpo-ro to the Seoul direction.
At the time, at night, a person engaged in driving of a motor vehicle has a duty of care to properly operate the brake system while living well on the front side.
Nevertheless, the Defendant neglected to operate the brake system under the influence of alcohol, and found the DNA Lone Star Cargo Vehicles that were driven by the victim C (the 52 years of age, women) late, carried out a sudden operation, but the distance is too difficult, and the Defendant did not avoid so too much, and led the part of the damaged vehicle to the front part of the Defendant’s vehicle.
Ultimately, the Defendant driven the said car in a situation where normal driving is difficult due to the influence of alcohol, and suffered injury to the victim C, such as brain-dead sugar, which requires a three-day medical treatment, and injury to the victim E, such as salt, tension, tension, etc.
