The litigation costs for retrial shall be borne by the plaintiff.

The grounds alleged by the Plaintiff (Plaintiff for Review) as the grounds for a retrial in the instant judgment subject to review cannot be a legitimate ground for retrial under each subparagraph of Article 451(1) of the Civil Procedure Act.

Therefore, the litigation of this case is dismissed as it is unlawful, and the costs of the retrial are borne by the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
