피고인은, 2006. 2. 23. 09:50 경 부산 사상구 덕포2동 천호중고자동차매매상사 앞 정류장을 승객 약 25명을 태우고 운행 중인 부산70 자0000호 00번 시내버스에서, 버스가 늦게 도착하여 오래 기다렸다는 이유로 운전기사인 피해자 이ㅇㅇ(47세)의 바로 옆에 서서 운전 중인 피해자에게 욕설을 하며 발로 피해자의 옆구리를 걷어 차 뒤에 있던 승객이 피고인을 껴안으며 말림에도 계속하여 운전석 옆에서 피해자에게 위협을 가하다가 위 승객이 정류장에서 내리고 피해자가 버스를 막 출발시킬 때 갑자기 피해자의 목 뒷부위를 주먹으로 탁 치며 핸들을 잡고 있던 피해자의 오른쪽 어깨를 잡아 당겨 피해자가 순간적으로 정신을 잃고 버스가 오른쪽으로 방향을 틀어 그대로 진행하게 하여 버스가 택시정류장 폴싸인을 부수고 인도 보도턱에 앞바퀴가 걸리며 정지함으로써 피해자에게 약 3주간의 치료를 요하는 목뼈의 염좌상 등을, 위 버스 승객인 피해자 정00(여, 37세)에게 치료일수 미상의 팔목과 목 부위의 통증을 느끼게 하는 상해를 가함과 동시에 위 버스 앞 범퍼 시가 458,900원 상당과 택시승강장 폴싸인 시가 950,000원 상당을 부수어 합계 1,408,900원 상당을 손괴하였다.

In light of the fact that the victim, who is a driver of a bus in a bus with approximately 25 passengers aboard the reason for sentencing, uses violence against the victim, as well as the fact that it causes considerable danger to many and unspecified persons of the road where the bus is driven, thereby making efforts to recover from damage, etc., it is ordered as per the disposition.
