1. The Defendant’s KRW 40,700,000 as well as 6% per annum from August 13, 2016 to December 5, 2016 to the Plaintiff.
Comprehensively taking account of the overall purport of the arguments in Gap evidence Nos. 1 through 4 (including additional numbers), the plaintiff is obligated to pay the plaintiff 40,700,000 won after deducting the amount of 40,700,000 won from the plaintiff 81,40,000 won of the agreed construction cost and 40,700 won from August 13, 2016 to December 5, 2016, which is the delivery date of a copy of complaint under the Commercial Act, and to pay damages for delay calculated annually from the day after the completion date of construction to the day of completion of construction to December 5, 2016, by 15% per annum as stipulated in the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings.
