The judgment below

In light of the records, the court below reversed the conviction part among the judgment of the court of first instance on the grounds that all of the facts charged (excluding the guilty part against Defendant B and C) against the Defendants did not prove a crime, and judged the acquittal part among the judgment of the court of first instance on the grounds that there is no proof of crime, and it is just to maintain the acquittal part in the judgment of the court of first instance. In so doing, contrary to the allegations in the grounds of appeal, the court below did not err by misapprehending the legal principles on the violation of the Election of Public Officials Act and the Political Fund Act, or by misapprehending

On the other hand, the prosecutor appealed against Defendant B and C in the judgment below, but did not indicate the grounds of appeal as to this part of the judgment of the court below.

Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
