1. The part against the defendant among the judgment of the court of first instance is revoked, and the plaintiff's claim corresponding to the revoked part is revoked.

Reasons

A. A sales contract was concluded (hereinafter “instant sales contract”).

The Plaintiff purchased the following six parcels, including D land, from six persons, including the Defendant, at KRW 850,00,000. The down payment of KRW 100,000,000 for the first part payment of KRW 50,000 for the first part payment of KRW 50,000 for the contract, and KRW 10,000 for the second part payment of KRW 50,000 for the second part payment of KRW 50,00 on July 31, 2014, and KRW 100,00 for the third part payment of KRW 550,00 for the remainder payment of KRW 50,00 on September 30, 2014.

2. Meanwhile, at the time of the conclusion of the instant sales contract, the Plaintiff and six parties including the Defendant added necessary matters for the development of the housing complex. Among them, six parties including the Defendant, etc. received sales balance from the Plaintiff, and at the same time, completed the registration of ownership transfer with respect to the Plaintiff as to the total land of six parcels including D land, and at the same time, they agreed to transfer the ownership of 1/2 of the said road site to the Defendant, a seller, at the time of completion of the designation of the road within the said six parcels.
