The litigation of this case shall be dismissed.
The litigation costs for retrial shall be borne by the plaintiff.
Reasons
The petition for retrial of this case is unlawful because it repeatedly filed a petition for retrial for the same reason, which has been dismissed or rejected, constitutes an abuse of the right of lawsuit.
Therefore, the litigation of this case is dismissed, and the costs of the retrial are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
