가. 피고인은 2012. 3. 내지 4.경 위 D교회에서, 피해자가 칠판에 그림을 그리면서 놀고 있는 것을 보고 다가가 피해자의 등 뒤에서 피해자를 갑자기 껴안아 꼼짝 못 하게 한 다음 피해자의 성기를 손으로 만져 피해자를 강제로 추행하였다.

나. 피고인은 2012. 3. 내지 4.경 남해군 G에 있는 자신의 집에서, 피해자가 컴퓨터를 하고 있는 것을 보고 다가가 피해자의 등 뒤에서 피해자를 갑자기 껴안아 꼼짝 못 하게 한 다음 피해자의 성기를 손으로 만지고, 다시 피해자의 앞 쪽으로 가서 싫다고 거부하는 피해자의 하의를 벗긴 다음 피해자의 성기를 손으로 만지고 혀로 핥고, 자신의 성기를 피해자의 성기에 갖다 대는 등 피해자를 강제로 추행하였다.

2. 피해자 F에 대한 범행 피고인은 2012. 5.경 위 D교회에서, 피해자가 칠판에 그림을 그리면서 놀고 있는 것을 보고 다가가 피해자의 등 뒤에서 피해자를 갑자기 껴안아 꼼짝 못 하게 한 다음 피해자의 성기를 손으로 만져 피해자를 강제로 추행하였다.
