Defendant shall be punished by a fine of KRW 70 million.
If the defendant does not pay the above fine, KRW 100,000.
A. The victim L, who was suffering from injury, made a false statement to the effect that “it is possible to adjust the above rent in consideration of the rate of price increase once every two years,” which reads that “it is possible to set up a K hotel, operating for 10 years as a rest hotel, raising profits, and paying rent of 650,000 won per month to the buyers.”
However, the above building obtained a building permit for business facilities (officetel 149) and urban residential housing (room-type 24 households) on August 23, 2013; there was no building permit for accommodation facilities; and there was no report on accommodation business in the relevant Gu office; and even if the above victim received some number of houses, the above building was operated as accommodation facilities for 10 years, and there was no intention or ability to pay the proceeds to the victim.
The Defendant received a total of KRW 351,895,00 on seven occasions from September 2, 2014, including transfer of KRW 60,000 from the above victim to the national bank account (2901-04-05,0512*) in the name of this trust, one stock company (2901-04-0512*), and received KRW 1,292,98,850 from the victim 9 to September 2, 2014, as shown in the crime inundation list from around that time, and received KRW 1,292,98,850 as the sale price for 11 houses from the victim 9 to September 2, 2014.
