The costs of appeal are assessed against the Plaintiff.

A final appeal may be filed against a judgment of the second instance of a small claim identical to this case only in cases falling under any of the subparagraphs of Article 3 of the Trial of Small Claims Act. The grounds alleged in the grounds of final appeal shall not constitute any of the above cases.

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
