가. 여수시 C 전 264㎡ 중 별지 감정도 표시 ㅋ, ㄴ1, ㄱ1, ㅎ의 각 점을...

Reasons

1. Fact-finding [based on recognition] Each entry of Gap 1, 3, 4, and 6 (including household numbers), the result of the commission of surveying and appraisal by the Korea Land Information Corporation, as a result of D’s entrustment of appraisal of rental fees, the entire purport of the pleadings is the owner of the land prior to C, and the defendant is the owner of the land of E, 483 square meters (hereinafter “E land”).

From March 2013 to October 2013, the Defendant used the instant land as a vehicle passage, etc. for the construction of a new building on the land of E from March 2013 to October 2013, and agreed with the Plaintiff to restore a stone fence removed for the said passage to its original state.

그런데 피고가 이 사건 토지의 경계를 넘어 별지 감정도 표시 ㅋ, ㄴ1, ㄱ1, ㅎ의 각 점을 차례로 연결한 선상에 돌담을 설치함으로써, 같은 감정도 표시 ㅋ, ㅌ, ㅍ, ㅎ, ㄱ1, ㄴ1, ㅋ의 각 점을 차례로 연결한 선내 (나) 부분 5㎡(이하 ‘이 사건 계쟁토지’)를 점유 원고의 2015. 1. 21.자 측량감정신청에 의하여 실시된 측량감정결과(2015. 4. 2.자 측량감정촉탁회신)이다.

On August 21, 2014, the second date of pleading, which is after the arrival of the Ministry of Land, Transport and Maritime Affairs for the survey and appraisal on August 21, 2014, the defendant expressed his intention to remove and restore the damaged part to its original state.

The monthly rent from March 12, 2013 to March 1, 2014 of the instant land is KRW 4,840, and the monthly rent is KRW 5,280 from March 12, 2014 to December 4, 2014.

2. 돌담 철거 및 원상복구, 토지인도, 임료 상당 금전지급 청구에 관한 판단 위와 같이 인정된 사실관계에 의하면, 피고는 원고에게 이 사건 계쟁토지상에 설치한 돌담을 철거하고, 별지 감정도 표시 ㅋ, ㅌ, ㅍ, ㅎ의 각 점을 차례로 연결한 선상에 설치되어 있던 돌담을 원상복구하며, 이 사건 계쟁토지를 인도할 의무가 있다.

This part of the claim by the plaintiff is justified.

The Plaintiff also sought payment of KRW 107,770 equivalent to the rent for the instant land from March 12, 2013 to December 4, 2014.
