1. Basic facts
A. On January 10, 2012, the Plaintiff was donated from Nonparty E on January 10, 2012 and completed the registration of ownership transfer on January 12, 2012.
B. The Defendant purchased on March 10, 1969 the adjacent land of this case on June 12, 1980 and completed the registration of ownership transfer on June 12, 1980.

2. Judgment on the plaintiff's claim
A. The Plaintiff’s claim is that the Plaintiff’s access to the land of this case, which is surrounded by surrounding land, is forced to pass through the land adjacent to this case owned by the Defendant, in order to contribute to a public road.
그런데, 피고는 원고가 이 사건 인접토지를 통행하지 못하도록 이 사건 인접토지 지상의 별지 도면 ㉡, ㉢, ㉣ 부분에 벽돌조 담벽을 설치하고 아울러 위 도면 ㉠, ㉤ 부분에는 철제대문까지 설치하였다.
따라서, ① 피고는 이 사건 인접토지 지상 별지 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉤, ㉠의 각 점을 순차 연결한 선내 ‘㉮’ 부분 43㎡에 관하여 원고에게 통행권이 있음을 확인하고, 위 ‘㉮’ 부분 43㎡에 원고의 통행에 방해가 되는 장애물을 설치하거나 기타 통행에 방해가 되는 일체의 행위를 하여서는 아니되며, ② 피고는 원고에게 위 ‘㉮’ 부분 43㎡에 설치된 벽돌조 담벽 및 철제대문을 각 철거할 의무가 있다.
(b) Therefore, in a case where there is no passage between a building site and a public road, which is necessary for the use of the surrounding land, and the owner of the surrounding land cannot access the public road, or the cost to reach the public road would be excessive, without passing over the surrounding land to the public road.
