The Defendant had been working in the State F, a broadcasting station, as an agent, for the management of companies that contributed to broadcasting, such as KBS’s “C”, “D”, and “E” program from March 2009 to April 2013, and for the production, etc. of advertising materials among the early police officers.

The Defendant, using the above experience, committed an attempt to receive money from a broadcasting company that contributed to broadcasting and a company that wants to contribute to broadcasting by misrepresenting the head of the broadcasting station and team, etc., to interfere with broadcasting photographing.

After that, the Defendant, around February 17, 2013, sent a phone call to the victim I who operates the “H” located in Yongsan-gu Seoul Metropolitan Government, and sent a video recording that introduces the “H,” operated by the President, to the KBC’s “C” and the “6:00 p.m. program.”

The author suggested that the victim should transfer the funds necessary for regular broadcasting and the production cost of promotional materials upon the consent of the victim.

However, the Defendant was not only the head of the shooting team belonging to the MBC broadcasting station, but also the head of the (State)F working at the time, and was an employee of the Information Team in charge of any business that is not related to the broadcast contribution of the relevant company, so even if receiving the money from the victim, the Defendant did not have any intention or ability to make the restaurant operated by the victim contribute to the public wave broadcasting

Nevertheless, on February 18, 2013, the Defendant was transferred KRW 1,900,000 to a new bank account (K) with the Defendant’s mother, as seen above, under the pretext of the cost of supporting broadcasting and the cost of producing promotional materials.

In addition, the Defendant’s total sum of KRW 154,080,000 between January 10, 2013 and July 19, 2013 under the pretext of the cost of supporting broadcasting and the cost of producing promotional materials from 19 victims to 57 times, such as the statement in the list of crimes.
