However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Around April 21, 2015, the Defendant posted a letter stating that “A victim E purchases contact diskettes” after accessing the Defendant’s house located in Busan Northern-gu, with a smartphone from the Internet opening bulletin board,” and said that “A victim E will transfer a contact tag to the Busan bank account (F) if he/she transfers KRW 113,500 to the remittance account.”

However, in fact, the defendant did not have the contact pockets, and the defendant thought that he would use the above money as living expenses, entertainment expenses, etc., so he did not have the intention or ability to sell the contact pockets to the victim.

4. From around 22.2 to June 23, 2015, a total of KRW 113,500,000 was remitted from the victims in the same way as shown in the List of Crimes (1) in the attached Form (1).

On June 10, 2015, the Defendant, at around 11:00 on June 10, 2015, posted a notice on the Defendant’s home located in Busan Northern-gu to the Defendant’s mobile phone (G) to the Defendant’s mobile phone, and concluded that the Defendant would send G3CAT6 to the Defendant, if the Defendant contacted the victim with “G3 CAT6 mobile phone purchase,” and that the Defendant would send KRW 235,000 to the subsidiary bank account (number F).”

However, even if the defendant was remitted from the victim, he did not have the intention or ability to sell the mobile phone.

As above, the Defendant, by deceiving the victim, received 235,000 won from the victim to the Busan Bank Account in the name of the defendant, and acquired by defrauding the victim.

2. The Defendant, at around 13:20 on June 26, 2015, posted a notice stating that the victim I “MH-23 UNH-23 nitroker inserted in the cell phone at the place indicated in paragraph (1) as indicated in paragraph (1), shall be exempted from sending KRW 30,000 to the Busan Bank account (Serial J).
