[2018 Highest 5234] The Defendant: (a) established a corporation by inviting the name holder and the total book B (Suspension of indictment on the same day) and the name holder; and (b) planned to sell the passbook under the name of the corporation to an illegal criminal organization using an illegal sports earth site, loan fraud, hosting, etc.; (c) directly recruited C, D, etc. as the name holder; or (d) had the Defendant F, H, H, I, J, J, K, L, M, N, N,O, etc. recruit as the name holder; and (c) established and registered a company under the name of F, etc. despite the absence of an actual intent to operate the company; and (d) decided to establish and register a “old corporation” in the name of the said corporation by using the passbook and cash card connected to the said account and sell the sports soil site, etc. to the organization selling it through an unlawful sports earth.
