A. On October 8, 2010, the Plaintiff, which was the Intervenor joining the Defendant, was the insurer of the instant vehicle, and was fully paid KRW 70 million in total to E, etc. on October 8, 2010.

2. The parties' assertion

A. The Plaintiff’s assertion that the instant accident occurred due to the Defendant’s joint tort, which did not perform his duty to protect D, such as paying safety equipment, such as safety belt, etc. as the Plaintiff’s driver B and D.

The plaintiff paid damages of KRW 70 million to the bereaved family members of D and paid damages of KRW 21 million against the defendant in subrogation of the above bereaved family members' rights to claim damages, which amount to 30% of the defendant's fault ratio (=70 million x 30%).
