1. Details of the disposition;
A. The Plaintiff was appointed as a policeman on August 5, 1989, and was promoted to the police officer on March 1, 2010. From February 10, 2020 to February 10, 2020, the Plaintiff was a police officer serving in the Busan Southern Police Station’s Living Safety and B boxes.
B. On April 2, 2020 following a resolution of the Busan Metropolitan City Police Agency Police Officers General Disciplinary Committee, the Defendant was subject to one month of suspension from office pursuant to Article 78(1)1, 2, and 3 of the State Public Officials Act on the ground that the Plaintiff committed the following misconduct and violated Article 56 of the State Public Officials Act.
원고는 부산남부경찰서 형사과 강력2팀에서 근무하면서, 피의자 도보 호송 시 수갑 및 포승을 2중으로 포박한 상태에서 경찰관 2명은 피의자의 양쪽 팔짱을 끼고 1명은 1미터 후방에서 포승줄 끝에 만든 매듭 속에 손을 넣어 2~3회 감은 후 동행하여야 함에도 2019. 12. 19. 08:00경 부산 수영구 C 소재 D병원 앞 노상에서 혐의자와 호송관 2명은 절도피의자를 도보 호송하며 느슨하게 앞수갑만 한 채 1명은 피의자 왼편에서 피의자의 팔을 잡고, 2명은 피의자 뒤에서 걸어가는 방법으로 호송하였으며, 피의자를 호송차량에 태울 경우에도 도주 대비에 주의를 기울여야 함에도 호송관 2명은 차량에 승차하여 내부 정리하였고 호송관 1명이 피의자 팔을 잡고 있던 중 피의자가 왼손을 수갑에서 뺀 뒤 옆에 서 있던 호송관 1명을 밀치고 도로를 횡단하여 도주함에 따라 피의자 관리를 소홀히 하였다.
