1. Basic facts
A. In order to carry out an apartment building project outside G and 24 lots of land (hereinafter “Mining Housing”) on November 22, 1999 for the purpose of implementing the apartment building project (hereinafter “instant project”). On November 22, 199, the Defendant purchased the amount of KRW 1,190 square meters of forest land E 8,3750,000,000,000 for the contract deposit, the contract deposit amount of KRW 8,3750,00,000 within one month, and the remainder of KRW 6,45,250,000,000 shall be paid within 30 days after the project approval. On the same day, the remainder of KRW 42,750,000,000 shall be paid within 30,000,000,0000 won for each of the instant projects (hereinafter “each of the instant real estate”). The contract shall be paid within 4,275,000,000 won for each of the intermediate payment.
B. According to each of the instant sales contracts, at the same time as the down payment is received, a seller shall issue a written consent to land use and a written consent to pledge (Article 4(1)) necessary for the authorization and permission of a multi-family housing business (multi-family housing) to the relevant government office (the purchaser) (Article 4(1)). In the event that the purpose of this contract is not achieved because the seller fails or neglects to perform his/her obligations under this contract, the seller shall compensate the buyer for not only the amount of the down payment already paid to the buyer, but also the total expected profit
(Articles 8(3) and 9(c).
From November 22, 1999 to May 19, 200, the Housing Construction paid to Defendant C the purchase price of KRW 41,4750,000 and KRW 185,500,000 to H, respectively.
In around 2001, the Housing Construction Co., Ltd. (hereinafter referred to as "construction notification") transferred all of the project rights, such as the implementation rights related to the project in this case and the right under the land sales contract, and the construction notification.
