2. 계속해서 피고인은 위 제1항과 같은 행위로 현행범인체포되어 F에 있는 D지구대에 인치된 후 2018. 11. 20. 01:25경 D지구대에서 위 E에게 “너 이 쌥새끼야 뒤졌어”라는 등의 욕설을 하며 우측 발로 피해자의 좌측 무릎 부위를 1회 걷어차 E을 폭행하였다.
