1. 피고인은 2011. 10.경 안산시 단원구 C상가단지 내 피해자 D(여, 48세) 운영 ‘E’에서 떡볶이를 구입한 후, 피해자에게 “나는 떡볶이에 오뎅이 많은 것이 좋은데 왜 오뎅을 조금밖에 넣지 않았냐”, “씨팔년, 좆 같은 년” 등의 욕설을 하고, 피해자가 피고인에게 ‘너 같은 아들도 있는 나한테 왜 욕을 하냐’고 하자, 피고인이 가지고 있던 위험한 물건인 과도를 들고 피해자의 가슴 앞에 들이대며 피해자를 찌르려는 태세를 보여 피해자를 협박하였다.

2.
