A. On October 11, 2015, the Defendant subcontracted the construction of stone to the Plaintiff among the construction of a new building located in Seongbuk-gu Daejeon District C, Daejeon, and thereafter the Plaintiff completed the said construction.

However, the Defendant paid only KRW 17,00,000, out of KRW 40,364,600 to the Plaintiff.

B. Therefore, the Defendant is obligated to pay to the Plaintiff damages for delay calculated at the rate of 15% per annum from November 1, 2016 to the day of full payment, which is the day following the delivery of a copy of the instant complaint, to the Plaintiff.

2. Articles 208(3)1 and 257(1) of the Civil Procedure Act, which hold a judgment without holding any pleadings.
