Punishment of the crime
No one shall introduce or induce a patient to a medical institution or a medical person for profit, such as exempting or discounting the patient's apportionment under the National Health Insurance Act or the Medical Benefits Act, providing money, goods, etc., or providing transportation convenience to many and unspecified persons, or instigate such act.
1. Defendant A and B’s joint criminal act is a person who operates the N Hospital in the Sing-gu Ma. Defendant A was the head of the above hospital from June 2010 to November 2012 and was in charge of the duties, such as the management of the entrance and discharge of patients.
In order to attract patients to the above hospital, the above Defendants thought that the patient is hospitalized by using a private transport company vehicle, which shall be borne by the patient and his/her guardian, to provide transportation convenience in lieu of this invoice.
On January 4, 2012, the above Defendants: (a) had the head of an O Center-Man Branch P at the above hospital transfer the name-free patient hospitalized at the above hospital from Q welfare center to the above hospital; and (b) delivered KRW 45,000 to P the patient’s side; and (c) from then to December 31, 2012, up to December 31, 2012, the Defendants engaged in the act of inducing the patient by providing transportation convenience, such as directly paying the total amount of KRW 11,895,00,00 in total, and having the patient transfer the patient.
2. Defendant C operated the S Hospital located in Gan-si L from July 10, 2010 to March 20, 2013.

C In order to attract patients to the above hospital, the patient was hospitalized by using a vehicle of a private transport company, and the patient was willing to provide transportation convenience by paying this fee instead of the patient and his/her guardian.
