1. The Defendant shall pay to the Plaintiff KRW 28,60,000 and the interest rate of KRW 15% per annum from April 1, 2016 to the date of complete payment.
Comprehensively taking account of the overall purport of the arguments as to Gap evidence Nos. 1 and 2, the plaintiff is obligated to pay to the plaintiff damages for delay calculated at the rate of 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from April 1, 2016 to the day of full payment, as the plaintiff seeks to execute construction work for the power line and electric light repair work for the defendant's factory at KRW 28,600,000, around February 2014. As such, the defendant is obligated to pay to the plaintiff damages for delay calculated at the rate of 28,60,000 per annum from April 1, 2016 to the day of full payment.
Therefore, the plaintiff's claim of this case is justified and it is so decided as per Disposition.
