1. The scope of the trial at this court primarily sought damages from the defendant and the co-defendant C's joint tort, the first preliminary loan, and the second preliminary contract amount. The court of first instance dismissed both the primary claim and the first preliminary claim, and partly accepted the second preliminary claim.
The scope of the trial of this court is limited to the second preliminary claim, since only the defendant appealed against this.
2. Paragraph 1 and Paragraph 3-B of the reasoning of the judgment of the first instance.
Since it is the same as the statement in the paragraph, it is accepted by the main text of Article 420 of the Civil Procedure Act.
3. In conclusion, the judgment of the first instance is legitimate, and the defendant's appeal is dismissed. It is so decided as per Disposition.
