The prosecution of this case is dismissed.
1. On July 4, 2020, at around 08:50 on the same day and around 09:24 on the same day, the Defendant: (a) in the Defendant’s residence in South-Namnam-Gun B; and (b) in the Defendant’s mobile phone using the Defendant’s mobile phone that the Defendant would not pay the Defendant money borrowed from the Defendant; (c) in preparation for money, the Defendant would be able to kill the Defendant at his own expense when he is prepared; and (d) in preparation for money, the Defendant would be able to kill the Defendant at his own expense when he is prepared; and (e) a person who would not be satched if he was killed;

By transmitting the text text messages stating "the last time of life, it must be said that the body or life of the victim or his/her family member," the victim was threatened with the victim by means of threatening to harm the body or life of the victim or his/her family member.
2. Determination
(a) Applicable legal provisions: Article 283(1) of the Criminal Act;
(b) Crimes of non-violation of intention: Article 283 (3) of the Criminal Act.
(c) Expression of intention not to impose punishment after prosecution: The victim shall express his/her intention not to want the punishment of the defendant in this court on December 1, 2020;
(d) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
