The costs of appeal are assessed against the defendant.

Based on the circumstances stated in its reasoning, the lower court determined that it is difficult to view that each of the instant agreements included the purport that the Defendant would not be liable for damages arising from the acquisition of the purchase fund from D in relation to the instant H land.

In light of the records, the above judgment of the court below is justifiable.

In so doing, contrary to what is alleged in the grounds of appeal, there were no errors by recognizing facts contrary to logical and empirical rules or by misapprehending the legal principles on the probative value of disposal documents

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
