1. Defendants are jointly and severally liable to the Plaintiffs for KRW 73,811,507 and KRW 30,000,000 among them, Defendant C shall be jointly and severally liable to the Plaintiffs on November 17, 2017.
On November 19, 2010, the facts that the Plaintiffs leased KRW 30 million to the Defendants at the rate of 3% per month and the due date of payment on April 30, 201 are no dispute between the parties or can be acknowledged by taking into account the overall purport of the pleadings in the statement in subparagraph 1.
According to the above facts, the Defendants are jointly and severally liable to pay the principal amount of KRW 73,811,507 to the Plaintiffs (i.e., KRW 43,811,507 from May 1, 201 to May 31, 2017) and the amount of KRW 30,000,000 from November 17, 2017 following the day when the duplicate of the application for payment order is served, Defendant C is liable to pay damages for delay calculated at the rate of 15% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from October 11, 2017 to the day after the copy of the application for payment order is served.
Therefore, the plaintiffs' claims against the defendants are justified, and this decision is delivered with the assent of all participating Justices.
